- Arctic Star LLP, having its registered address at 308, 3rd Floor, Panchratna Building, Opera House, Mumbai 400 004 (“Arctic Star”) is managing and operating this website www.arcticstar.in (“Website”) through which it inter alia facilitates the sale of Lab-Grown Diamond studded jewellery in Hallmark Gold (“Products”) to the users of the Website (“Users”)
- This Shipping & Delivery Policy (“Policy“) sets out the policies and procedures towards delivery and shipping of Products purchased on the Website
- Arctic Star provides shipping and delivery of Products pan India and internationally by partnering with third party logistics service providers (“Logistic Partners“) to handle orders. Arctic Star makes all commercially reasonable endeavours to ensure that the Products are delivered to the User in a timely fashion.
- By agreeing to use the Website the User agrees to be bound by the terms of this Policy. Arctic Star encourages the User to read and understand the terms of this Policy. If the User does not agree with any of the terms of this Policy, such User is strongly advised to refrain from accessing or using the Website.
2. Terms of Shipping & Delivery
- Arctic Star provides the details of the Logistic Partner responsible for the shipping and delivery of any Product purchased by the User on the Website when such Product is processed and successfully handed over to the Logistic Partner by Arctic Star. The User agree that though Arctic Star effectuates Product shipping and delivery to the User through Logistics Partners, Arctic Star reserves the right to ship and deliver the Products without engaging any Logistic Partners.
- The User agrees that Arctic Star may, in its sole discretion, determine a select list of areas that are unserviceable for shipping and delivery of Products. Arctic Star and its Logistic Partners do not provide shipping and delivery services in such unserviceable areas and may not process orders on the Website in such cases. In the event an area has been deemed unserviceable by us, Arctic Star shall notify such User at the time of placing an order for purchase of Products on the Website.
- The User agrees and acknowledges that to effectuate timely delivery of the purchased Products, Arctic Star may inquire or collect specific information including but not limited to the User’s name, shipping address, billing address, landmarks and contact details. The User shall ensure that all information that is submitted to Arctic Star on the Website is true, complete, accurate and sufficient to identify the actual place of delivery. The User shall bear absolute liability in case of any failure by Arctic Star in delivering the purchased Products due to the User’s failure to provide correct, complete, sufficient and accurate information at the time of placing the order.
- If the delivery attempt is unsuccessful and the User continues to remain unavailable, Arctic Star reserves the right to cancel the order of the purchased Products at its sole discretion and process the return of such Product. Arctic Star further reserves the right to deduct the shipping and delivery charges, if any, borne while processing any refunds subsequent to such cancellation.
- While Arctic Star will make reasonable endeavours in ensuring that the purchased Products are delivered to the User in a timely manner, the User accepts and acknowledges that the delivery may be delayed on account of logistical issues beyond Arctic Star’s control, unsuitable weather conditions, political disruptions, strikes, acts of God and other unforeseeable circumstances. In such events of delay, Arctic Star shall make reasonable attempts to inform the User by writing to the email ID and/or mobile number registered with us. Arctic Star disclaims all liabilities that may arise on account of our failure to inform or notify the User of delays in the delivery of purchased Products on the Website. Further, Arctic Star shall be under no obligation to compensate the User for any claim that may otherwise arise on account of delay in the shipment or delivery or use of the purchased Products.
- The User agrees that the actions and inactions of delivery individuals are not in Arctic Star’s control. Arctic Star shall not be liable for any acts or omissions on part of the Logistics Partner or their employees, agents, or personnel including but not limited to deficiency in service, wrong delivery of Product, time taken to deliver the Product, and Product package tampering. Any issue arising between the User and the Logistics Partner or their employees, agents, or personnel will be resolved by the User independently. The User agree not to hold Arctic Star responsible or require Arctic Star to settle, mediate or resolve any disputes between the User and the Logistics Partner or their employees, agents, or personnel.
- Arctic Star reserves the right to charge or collect shipping fees and additional tax duties levied on shipping of Products. Shipping charges may vary based on factors including but not limited to the value of the Product, type of Product, area of delivery and payment mechanism. The User agrees that Arctic Star is authorized to collect the shipping and delivery fees for the delivery service provided by the Logistics Partner on behalf of the Logistics Partner. The User accepts that the title and risk of all Products ordered by the User shall pass to the User upon the delivery of the purchased Products to the User.
- On request of the User, products purchased on the Website may be collected by the User or their authorized representative from the following address – 308, 3rd Floor, Panchratna Building, Opera House, Mumbai 400 004.
3. Modification
Arctic Star reserves the right to modify this Policy from time to time. The Policy shall be updated on the Website. Arctic Star encourages all Users to review this Policy whenever she/he visits the Website.
4. Severability
If any provision of this Policy is held to be invalid or unenforceable for any reason, the remainder of the provisions will continue in full force and effect as if this Policy had been executed with the invalid portion eliminated.
5. Governing Law
The terms of this Policy shall be governed and construed in accordance with the laws of the Republic of India.
6. Dispute Resolution
In case of any dispute arising out of this Policy, the same shall be adjudicated by the sole arbitrator appointed by Arctic Star, as per provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be Mumbai and language used English.
