Cancellation, Return & Refund Policy

  1. General
  • Arctic Star LLP, having its registered address at 308, 3rd Floor, Panchratna Building, Opera House, Mumbai 400 004 (“Arctic Star”) is managing and operating this website www.arcticstar.in (“Website”) through which it inter alia facilitates the sale of Lab-Grown Diamond studded jewellery in Hallmark Gold (“Products”) to the users of the Website (“Users”)

     

  • This cancellation, return and refund policy (“Policy“) sets out the procedures and policies in accepting cancellations, returns and refunds of purchased Products.
  • By agreeing to use the Website, the User agrees to be bound by the terms contained in this Policy. If the User does not agree to the terms contained in this Policy, the User is strongly advised not to transact on the Website.
  • Arctic Star may from time to time change the terms of the Policy that govern the Website. The User is advised to check the Policy to ensure understanding of the applicable terms and conditions.

2.Cancellation of Products

  • The User may cancel orders for Products prior to the issuing and processing of the invoice in relation to such Products by Arctic Star. Orders cannot be cancelled once the invoice has been processed and issued.

     

  • The User may cancel the placed purchase order by requesting Arctic Star to process a cancellation by sending an email to the address given under ‘Contact Information’ below and thereafter making a phone call to the number given under ‘Contact Information’ below.
  • On receipt of the cancellation request prior to issuing and processing of the invoice, Arctic Star shall cancel the order and initiate the refund for the Products within 10 business days from the receipt of the cancellation request from the User.

3. Return of Products

  • The User may initiate a request for return of the Product in the event that the Product is damaged, parts of the Product is missing or the Product received by the User is different from what was ordered basis the Product description provided on the Website (“Non-Compliant Product”). Such request may be initiated by sending an email to the address given under ‘Contact Information’ below and thereafter making a phone call to the number given under ‘Contact Information’ below.The User shall initiate such requests for a return within 5 business days from the date on which the User receives delivery of the Product (“Return Period”) failing which Arctic Star shall accept return of the Product at its sole discretion.
  • The User shall keep the Products in its unused, original condition, along with outer box and original accessories in manufacturer packaging for a successful return pick-up. Arctic Star will accept the request for return of such Product subject to the terms of this Policy.
  • If the User have received any Product which is eligible for return under this Policy, Arctic Star advises the User to immediately register a request in this regard by email to the address given under ‘Contact Information’ below and thereafter making a phone call to the number given under ‘Contact Information’ below. Arctic Star will in its sole discretion verify the eligibility of the Product for return under this Policy and thereafter accordingly accept or reject the request for return. For such verification, Arctic Star may request the User to send images of the damaged or Non-Compliant Product received and/or allow Arctic Star’s personnel to schedule a visit to assess the damage or non- compliance of the Product. Further to the assessment of the damage or non- compliance reported in the return request, Arctic Star may in its sole discretion resolve the issue in such manner as Arctic Star may deem fit.
  • The User’s return will be processed only when the following conditions are fulfilled at the time of return of such Products – the Product being returned in original condition, along with the price tag intact including original packaging of the product, the brand outer packaging of the Non-Compliant Product and all accessories therein, no damage having occurred post-delivery of the Product while in the User’s possession.
  • The User agrees that Arctic Star will not accept the return of any Product if the User fail to register a complaint in relation to a Product within the Return Period.
  • Notwithstanding anything stated in this Policy, Arctic Star reserves the right to reject the return request for a Product at its sole discretion.
  • Return of purchased Products are facilitated through our reverse-logistics partners. On receipt of request for return of Product and the same being duly acknowledged by Arctic Star, the reverse-logistics partners will collect the purchased Products from the User. However, Arctic Star reserves the right to collect the Products without engaging any Logistic Partners.

4. Refund of Payment for Products

  • Upon a successful request for return or cancellation of the Products the User may seek refund for the amount paid for the Product. Such refund may be made to the User only in the event the full payment has been received by Arctic Star for the Product.

     

  • The refund amount for Products that are eligible for return as per the terms of this Policy, as determined by Arctic Star in its sole discretion, will be processed within a period of 14 business day from the date of Arctic Star accepting the request for return of the Product.
  • The refund amount, if any, will be credited to the original payment mode opted by the User. The User acknowledges that after initiation of refund, it may take additional time for the refund amount to reflect in the User’s account.
  • Any refund to be made to the User shall not include any amount paid towards shipping charges or any other such charges applicable from time to time.
  • Notwithstanding anything stated in this Policy, Arctic Star reserves the right to accept, partially accept, or reject a refund request for a Product at its sole discretion upon assessment of the Product pursuant to its return. Arctic Star may in such cases notify the User and send the returned Product back to the User without initiating a refund.

5. Modification

Arctic Star reserves the right to modify this Policy from time to time. The Policy shall be updated on the Website. Arctic Star encourages all Users to review this Policy whenever she/he visits the Website.

6. Severability

If any provision of this Policy is held to be invalid or unenforceable for any reason, the remainder of the provisions will continue in full force and effect as if this Policy had been executed with the invalid portion eliminated.

7. Governing Law

The terms of this Policy shall be governed and construed in accordance with the laws of the Republic of India.

8. Dispute Resolution

In case of any dispute arising out of this Policy, the same shall be adjudicated by the sole arbitrator appointed by Arctic Star, as per provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be Mumbai and language used English.
